CLARITY Act Missed the Crypto Freeze Button After $6.3B Binance Hack 🧊
Wyoming Senator Cynthia Lummis said the stalled CLARITY Act would have given crypto exchanges immediate legal authority to freeze suspicious funds, potentially limiting some of the $6.3B in losses linked to the October 29, 2026 Binance hack.
Attackers drained roughly $6.3 billion from Binance hot wallets across multiple chains in under four hours, marking the largest crypto theft in history. Chainalysis and TRM Labs blamed North Korea’s Lazarus Group, specifically its TraderTraitor unit. Binance said no private keys were leaked and attributed the breach to a compromised DevOps engineer’s laptop.
Lummis cited the response by stablecoin issuers, which froze about $3B in stolen assets, as evidence that rapid freezing tools already exist. Ripple froze $200M in RLUSD. The senators said a statutory framework could have provided exchanges with clearer authority to freeze suspicious funds during an attack.
The CLARITY Act failed to secure the 51 votes needed for Senate cloture in a 49-50 vote on September 15, leaving the proposed framework stalled as the midterm elections approach.
