Australia Says "Hold My Beer" to Crypto Wild West With Stricter Exchange Rules 🍺

Australia's financial regulator opened a 45-day public consultation on proposed standards that would require cryptocurrency exchanges and digital asset custodians to safeguard customer funds, execute trades transparently and meet new financial requirements under laws set to take effect April 8, 2027. The Australian Securities and Investments Commission (ASIC) published the consultation paper on Thursday, with the comment period closing Nov. 27 and final guidance expected in March 2027.

The rules would require affected firms to obtain or update regulatory approval. Crypto companies already operating in Australia would have until Oct. 7, 2027, to apply for a license and could continue serving customers while ASIC reviews their applications. For investors, the changes would introduce clearer standards on how platforms hold assets, route orders and manage conflicts of interest, while crypto firms would face new compliance and capital obligations to operate legally in the country.

The proposals are part of Australia's effort to bring digital asset businesses under the same regulatory framework as traditional financial firms. Parliament passed the underlying legislation in April, following moves by the European Union, Singapore and Hong Kong to introduce dedicated crypto regimes. The shift comes years after the 2022 collapse of FTX left about 30,000 Australian customers unable to access funds, and three years after New Zealand–based exchange Cryptopia went bankrupt following a major hack.

ASIC Commissioner Alan Kirkland framed the approach as one of consistent treatment across financial activities. "Our approach is based on the principle of 'same activity, same risk, same regulatory outcome' to align Australia with the approach of comparable overseas jurisdictions," Kirkland said. Under the consultation paper, platforms would be subject to ongoing obligations covering custody, market integrity and financial resilience.

The regulator's advance notice gives exchanges and custodians roughly six months to adjust operational and compliance systems before the new standards apply, with the subsequent licensing window extending another six months for incumbent firms. ASIC said it would publish final rules in March 2027 following the consultation.
