CFTC Chair Names Six "Digital Commodities" — XRP Makes the Cut, Crypto Lawyers Salivate 🏷️
The U.S. Commodity Futures Trading Commission has identified Bitcoin ($BTC), Ethereum ($ETH), Solana ($SOL), Stellar ($XLM), Tezos ($XTZ) and $XRP as examples of "digital commodities" under a joint crypto asset classification framework developed with the Securities and Exchange Commission. CFTC Chairman Mike Selig outlined the designations while explaining the framework, according to reporting from Wu Blockchain.
Selig's remarks come as the CFTC begins drafting its first formal rules for the cryptocurrency market. The Chair stated the agency plans to differentiate between various activities and asset types rather than classifying the entire crypto market under a single category, signaling a more granular approach to oversight of digital assets in the United States.
The six named tokens represent a cross-section of the digital asset landscape, spanning the largest cryptocurrency by market capitalization, leading smart-contract platforms, payment-focused networks and a long-disputed token whose regulatory status has been the subject of multi-year litigation. Their inclusion as illustrative examples — rather than an exhaustive list — leaves open the question of how other tokens may be categorized under the same framework.
The classification effort reflects a coordinated push by the CFTC and SEC to clarify which federal regulator has authority over which crypto assets and the trading venues and intermediaries that handle them. By identifying "digital commodities" as a distinct category, the agencies are laying groundwork for tailored rules governing spot markets, derivatives and custody arrangements.
Selig's comments stop short of a binding legal determination for any specific token, and the framework remains subject to further rulemaking. The CFTC has not yet indicated a timeline for completing the initial set of formal rules for the cryptocurrency market.
