SEC Yolos 3x Bitcoin & Ethereum ETFs Into Existence, Volatility Wishes You Luck 🎲
The Securities and Exchange Commission approved a rule change on October 2 allowing the Cboe BZX Exchange to list six new leveraged commodity funds from Volatility Shares, including products designed to deliver three times the daily price moves of Bitcoin and Ethereum, alongside gold, silver, crude oil and natural gas, according to the agency's order. The funds will trade on Cboe like standard stocks, marking the latest expansion of the U.S. crypto investment pipeline that began with spot Bitcoin ETFs in January 2024 after a decade of rejections.
Each fund targets a 3x daily return, meaning if Bitcoin futures rise 2% in a single session, the fund aims for a 6% gain; if futures fall 2%, the fund aims for a 6% loss. Volatility Shares, the issuer behind existing 2x Bitcoin and Ethereum products, primarily obtains that exposure through futures contracts, which are agreements to buy or sell an asset at a set price on a future date. The firm launched the first leveraged crypto ETF in the U.S. in 2023, tracking Bitcoin futures, and the new approvals extend its lineup at the higher end of the leverage spectrum.
The daily reset mechanism embedded in these products can produce outcomes that diverge sharply from a simple 3x move over longer periods. If Bitcoin futures drop 10% on Monday and then rise 10% on Tuesday, the underlying asset finishes down 1%, while a 3x fund falls 30%, rebounds 30% and ends down 9% across the two sessions. The SEC and FINRA have jointly warned that returns over more than a single day can differ significantly from the stated daily target, a risk regulators and brokerages are required to disclose under Regulation Best Interest and FINRA's margin and suitability rules for leveraged products.
Cboe's fast-track listing standards for commodity-based funds exclude any product seeking a multiple of an asset's return, so each of the six funds required individual SEC approval rather than a routine exchange listing. Beyond the 3x leverage target, the funds must satisfy Cboe's other listing requirements, and the SEC relied on existing broker-dealer guardrails rather than imposing new conditions specific to these products. The push for higher-leverage crypto ETFs has accelerated in recent months, with Defiance filing in October 2025 for 49 funds offering 3x long and short exposure and Volatility Shares separately filing for 5x products.
The CFTC has also moved to expand its role in crypto oversight, publishing on Monday an advance notice of proposed rulemaking that seeks public input on a federal framework for digital asset trading, an early step following the collapse of the Clarity Act last month. Separately, the SEC in December 2025 halted review of certain pending crypto ETF applications, underscoring the case-by-case nature of the agency's approval process. Tickers for the newly approved funds will trade under standard Cboe designations alongside spot and existing leveraged products tied to $BTC and $ETH.
