Clayton's Back: The Ripple-Litigator Now Piloting Trump's "Super Intelligence Force" ðŸ§
Former Securities and Exchange Commission Chair Jay Clayton, the official who filed the 2020 securities lawsuit against Ripple Labs, has been tapped by President Donald Trump to lead the newly created White House "Super Intelligence Force" (SIF), with the appointment announced on October 4, 2026. The SIF is a federal advisory body charged with coordinating artificial intelligence policy across U.S. agencies, and its chairmanship places Clayton at the center of Washington's emerging AI agenda.
The appointment cuts across one of the most consequential crypto enforcement actions of the prior decade. Clayton's SEC sued Ripple in December 2020 alleging that the company's sales of XRP constituted an unregistered securities offering. In July 2023, Judge Analisa Torres of the U.S. District Court for the Southern District of New York ruled that programmatic sales of XRP did not satisfy the third prong of the Howey test, though she found that institutional sales did qualify as securities offerings. A 2026 joint interpretation by the SEC and the Commodity Futures Trading Commission subsequently treated XRP as a commodity, effectively closing the case. Clayton's lawyers have noted that the matter is now resolved and poses no legal exposure in his new role.
Crypto policy analysts have focused on the SIF's first deliverable: a 120-day report due in early 2027. The document is expected to address agentic AI systems, compute infrastructure and the use of stablecoins in machine-to-machine settlement, areas that directly intersect with blockchain-based payment rails. Any language the SIF adopts on stablecoin settlement or autonomous agents is likely to inform subsequent rulemaking by the SEC, CFTC and Treasury Department.
The report's timing comes against a backdrop of sharp year-to-date moves across major digital assets. Ether gained roughly 70% in the third quarter of 2026, while Bitcoin rose about 42% over the same period, according to market data. A separate 2026 Crypto Liquidity on Centralized Exchanges report from CoinGecko found that ETH's median daily market depth within the 0.15% band around the mid-price, roughly plus or minus $3 at current levels, settled between $13 million and $45 million, equivalent to 35% to 45% of Bitcoin's depth, compared with at least 60% a year earlier. CoinGecko described the drop as stark, even as prices climbed.
SIF members and the scope of its statutory authority are expected to be published in the Federal Register in the coming weeks, with the panel's first formal meeting slated for later this month.
