Clayton Returns: The Man Who Took On Ripple May Now Run AI Policy 🤖

Former SEC Chairman Jay Clayton, who initiated the securities case against Ripple during his tenure leading the regulator, is being considered by President Donald Trump for the role of "AI Czar," a position that would put him in charge of federal artificial intelligence policy. The potential appointment marks a return to public prominence for Clayton, whose name became closely associated with the enforcement actions targeting the XRP issuer and its executives.

Clayton served as SEC Chairman from 2017 to 2020, a period during which the agency filed its complaint against Ripple Labs alleging that the company conducted an unregistered securities offering through the sale of XRP. The case, which named Ripple Labs CEO Brad Garlinghouse and co-founder Chris Larsen as defendants, became one of the most closely watched enforcement matters in the crypto industry and remains a reference point in debates over digital asset regulation.

The "AI Czar" role, as described in reporting about the consideration, would be responsible for coordinating artificial intelligence policy across the federal government. Trump has signaled interest in establishing the position as part of broader efforts to shape U.S. policy on emerging technologies. No official nomination or appointment has been announced, and Clayton's potential selection remains under review.

Clayton left the SEC in December 2020 and subsequently rejoined the law firm Sullivan & Cromwell, where he had previously served as a partner before his government tenure. He has also taken on advisory and board roles in the private sector. The prospect of Clayton leading AI policy has drawn attention in the crypto community given his regulatory history with Ripple and XRP, an asset that trades under the ticker $XRP.

The Ripple case itself has seen significant developments, with portions of the litigation resolved through rulings and settlements in subsequent years, though elements of the dispute continued to move through the courts. The original enforcement action against Ripple and the broader regulatory posture of the SEC under Clayton are frequently cited in policy discussions about how digital assets such as $BTC and $ETH should be classified under U.S. securities law.

The White House has not confirmed any final decision regarding the AI Czar position, and Clayton's potential appointment remains a matter of consideration rather than a formal selection. Any confirmation process would be subject to standard review, and no timeline for an announcement has been disclosed.
