Hayes Ditches the "Crypto Regulation" Fairy Tale as $BTC Cracks $84K 🪄

—By our Markets Desk2 min read

Bitcoin climbed above $84,000 during Monday morning trading, rising roughly +5% and extending its weekly gain to more than +8%, just days after the U.S. Senate blocked the CLARITY Act and the Federal Reserve delivered its first interest rate hike since July 2023. BitMEX co-founder Arthur Hayes, now CEO of Flop Labs, used the sequence to argue in an X post that crypto legislation was never the market's missing ingredient. "See we didn't need some nonsense piece of crypto regulation, Clarity Act, just a rate hike that puts more dollars in the hands of rich people to consume more financial assets," Hayes (@CryptoHayes) wrote on September 18, 2026.

The two catalysts landed within 24 hours of each other. The Senate failed to invoke cloture on the CLARITY Act on Tuesday by a 49-50 vote, short of the 60 votes needed to advance the bill, according to coverage of the stalled Senate vote. The next day, the Federal Open Market Committee voted 12-0 to raise the federal funds target range by a quarter point to 3.75%-4.00%, its first increase in more than three years. The Federal Reserve said inflation remains elevated and framed the move as supporting a faster return to its 2% target, as reported by The Block.

The combined moves have fueled a narrative that the bottom is in and a full bull cycle is underway in Q4 2026. BTC USD has now added more than +8% over the past seven days, with the push past $84,000 punctuating the rebound from earlier-month lows. Hayes's framing, however, treats the rate hike as the operative lever and the failed CLARITY Act as a distraction that the market never depended on in the first place.

The CLARITY Act's path forward remains unresolved. A subsequent post from the account Bitcoin Intelligence (@BitcoinIntelX) on September 21, 2026 said the U.S. Senate was set to hold a key vote the following day at 2:15 p.m. ET and claimed Democrats had agreed to support an updated version of the bill, a claim that has not been independently confirmed in the filings reviewed. With the Senate's September vote on record and the FOMC having already moved, the immediate question for traders is whether the liquidity effect Hayes described can sustain the move above $84,000 into the rest of the quarter.
