Senate Schedules Friday Showdown for CLARITY Act — 60 Votes or Bust 🏛️

U.S. Senate Majority Leader John Thune confirmed on August 3 that H.R. 3633, the Digital Asset Market Clarity Act, will receive a Senate floor vote before the August recess, though the bill remains absent from the official Senate floor calendar and no cloture motion has been filed. "We have a bunch of stuff that we have to finish, and we'll just stay here until we finish it," Thune told reporters, listing a continuing resolution, a 74-person nominations package, Russia sanctions, the crypto market structure bill, and Jonathan Blanche's nomination among pending items. "I think market structure we'll get a vote on. Whether we can get on it or not, we'll see," he added.

The procedural path forward hinges on a Wednesday cloture filing. Crypto analyst Ted Pillows noted that if Senate leadership waits until Wednesday, August 6, to file cloture, the earliest possible floor vote would fall on Friday, August 8, leaving almost no margin before the chamber disperses for its state work period. The primary source identifies August 7 as the last functional Senate workday, with August 10 marking the visible close of the window. The Senate schedule for Tuesday, August 4 omitted the CLARITY Act, with senators instead handling H.R. 6500, a vehicle for the Continuing Resolution, along with votes on the nomination of Erica Schwartz to head the Centers for Disease Control and Prevention and a group of 74 en bloc nominations.

Senator Cynthia Lummis of Wyoming told crypto journalist Eleanor Terrett that Senate Majority Leader John Thune has kept the CLARITY Act on the agenda before the August recess "for many, many weeks now." "I believe he does intend to go through with it," Lummis said. "We will be proceeding, and I can't tell you whether it's going to be tomorrow, or Monday, or Tuesday." She identified multiple competing priorities, including nominees, a continuing resolution, and "Iran and Ukraine-slash-Russia sanctions." Rep. Mike Haridopolos of Florida, a House Financial Services Committee member, reaffirmed his support on Fox Business' Mornings with Maria, stating, "This is about making sure that American markets are the premier markets in the world." He voted for the bill when it passed the House 294-134 in July 2025.

The CLARITY Act would draw jurisdictional lines between the Securities and Exchange Commission and the Commodity Futures Trading Commission, leaving the SEC with oversight of investment contracts and tokenized securities while granting the CFTC full spot market regulatory authority over digital commodities. It is backed by Coinbase, Ripple, BlackRock, and Charles Schwab, and faces opposition from NY Attorney General Letitia James. Grayscale Investments sent a letter to Senate lawmakers urging action, stating that "Senators and staff across the aisle have spent months addressing hard questions about jurisdiction, investor protections, and developer safeguards," and noting that its digital asset products are held by hundreds of thousands of Americans.

Bipartisan support remains uncertain. Punchbowl News reporter Brendan Pedersen wrote on X that "There is a clear consensus among Senate Democrats right now that — without movement on ethics, illicit finance and stablecoin yield — a cloture vote this week on the Clarity Act will fail," adding, "Democrats won't be moved by crypto cash at this point." Senator Thom Tillis and Senator Ruben Gallego have forwarded a bipartisan ethics counterproposal that would empower state attorneys general to sue the Department of Justice if it fails to enforce the ethics provision, but President Donald Trump has yet to sign off on it, according to Eleanor Terrett. NYDIG global head of research Greg Cipolaro said on July 24 that the latest draft "is a substantially more complete bill, but not yet one with a credible path to 60 votes." Galaxy Research lowered its probability of the CLARITY Act passing in 2026 to 30%, while Polymarket currently shows a 23% chance of it being signed into law this year, down from 82% in February. Bitwise chief investment officer Matt Hougan wrote on Wednesday that a failure to pass the bill would put it in a "walking dead" state, adding, "The reality is that Washington is always late to major technology shifts, and it has rarely mattered as much as people feared."
