Crypto's August to-Do List: Pass CLARITY, Dodge Filibuster, Outrun Recess 🚂
Senate Majority Leader John Thune confirmed on August 3 that H.R. 3633, the Digital Asset Market Clarity Act, will receive a Senate floor vote before the August recess, though the bill has yet to appear on the official Senate floor schedule and no cloture motion has been filed. Thune told reporters the chamber has a "bunch of stuff that we have to finish, and we'll just stay here until we finish it," listing a continuing resolution, a 74-person nominations package, Russia sanctions, and the crypto market structure bill among pending items. "I think market structure we'll get a vote on. Whether we can get on it or not, we'll see," Thune said.
Senator Cynthia Lummis of Wyoming separately affirmed that Majority Leader Thune has held a place for the CLARITY Act on the pre-recess agenda "for many, many weeks now." Lummis told crypto journalist Eleanor Terrett that lawmakers have "one more week here in Washington" and "a lot of key things vying for floor time," including multiple nominations, a continuing resolution discussion, and votes on "Iran and Ukraine-slash-Russia sanctions." She added that "I believe he does intend to go through with it," though timing remains fluid: "We will be proceeding, and I can't tell you whether it's going to be tomorrow, or Monday, or Tuesday."
Procedural mechanics are tight. The Senate calendar on August 3 carried a 5:30 p.m. cloture vote, but on H.R. 6500, not H.R. 3633. According to crypto analyst Ted Pillows, if Senate leadership waits until Wednesday, August 6, to file cloture on the CLARITY Act, the earliest possible floor vote would fall on Friday, August 8, leaving almost no margin before the chamber disperses for its state work period. Pillows warned the delay would leave "very little time" for senators to begin debating the legislation before leaving Washington and that "unless Senate leaders speed up the process through a unanimous consent agreement or another procedural shortcut, the window to advance the Clarity Act before the recess is quickly closing." The Senate previously put the bill on hold on July 28 to process 74 Trump nominations.
The bill passed the House in July 2025 with broad bipartisan support, 294 votes to 134, and is backed by Coinbase, Ripple, BlackRock, and Charles Schwab, while drawing opposition from New York Attorney General Letitia James. The legislation would draw jurisdictional lines between the Securities and Exchange Commission and the Commodity Futures Trading Commission, with the SEC retaining oversight of investment contracts and tokenized securities while the CFTC acquires full spot-market regulatory authority over digital commodities. In the Senate, passage requires 60 votes to clear the filibuster threshold, meaning Republicans must assemble roughly seven Democratic votes. Grayscale Investments sent a letter to Senate lawmakers urging action, stating that "Senators and staff across the aisle have spent months addressing hard questions about jurisdiction, investor protections, and developer safeguards," and noting that its digital asset products are held by hundreds of thousands of Americans.
Industry and political pressure is intensifying on multiple fronts. Florida Congressman Mike Haridopolos, a House Financial Services Committee member who voted for the bill, reaffirmed his support on Fox Business' Mornings with Maria, stating, "This is about making sure that American markets are the premier markets in the world," and warning that Democratic delays risk handing digital asset leadership to overseas markets. Meanwhile, President Donald Trump has yet to sign off on a bipartisan ethics counterproposal from Senators Thom Tillis and Ruben Gallego, which seeks to empower state attorneys general to sue the Department of Justice if it fails to enforce the ethics provision. Per Terrett, citing sources familiar with the matter, the White House has yet to respond to the proposal, which is aimed at resolving a key Democratic objection to the bill. Prediction-market odds of Trump signing the CLARITY Act into law this year fell below 30% as the recess deadline approached, with Bitcoin ($BTC) trading at $63,508.82, up 0.01% over 24 hours at the time of writing.
