Sheriffs Finally Say "Howdy" to DeFi as CLARITY Act's Wanted Poster Gets Quieter 🪙

—By our Regulation & Policy Desk2 min read

The Major County Sheriffs of America (MCSA) has shifted from opposing the DeFi provision in the CLARITY Act to a neutral stance, a move seen as significant progress for the crypto bill. The law enforcement group stated that the decision followed continued review of the legislation.

In a letter to Senate Banking Committee Chair Tim Scott and Ranking Member Elizabeth Warren, the MCSA said it now holds a neutral position on the Blockchain Regulatory Certainty Act provision within the bill. The provision protects crypto developers from liability for illicit activity conducted by users on their decentralized platforms. Law enforcement groups had previously argued the provision complicates efforts to address illicit finance, creating a major obstacle for the CLARITY Act.

The MCSA indicated that its updated stance reflects continued legislative review and appreciation for the Administration's willingness to engage with law enforcement on the practical implementation of the rules. The shift comes after the group's position had been cited as one of the key points of contention surrounding the DeFi language.

Market observers noted that the odds of the CLARITY Act passing this year are again climbing following the development, after declining to new lows earlier in the week. President Donald Trump has previously signaled support for advancing crypto regulatory legislation during his term. The bill continues to move through committee review as stakeholders on both sides continue to assess its implications for decentralized finance platforms operating in the United States.
